(hereinafter: "Warranty Card")

Dear Customers,

Thank you for using our services. We are truly grateful for your trust in our company. We guarantee that our products have been manufactured with the utmost precision and from the finest materials. Before using TABELL furniture, please read the terms and conditions described in this warranty card. Please also note that furniture made of natural wood may vary slightly in structure and color, which is a testament to its natural character and value.

The document was created on the basis of Article 577 of the Civil Code.

§1 GENERAL PROVISIONS

  1. The guarantor and manufacturer of TABELL brand furniture is: Mr. Michał Balak, conducting business activity under the name MB Michał Balak, company headquarters: ul. Zygmunta Kuźmy 99, 34-105 Stanisław Górny, with tax identification number NIP 551-264-23-94, REGON 384835684, (hereinafter: "Guarantor" or "Manufacturer")
  2. Guarantor's details for submitting complaints: e-mail: reklamacje@tabell.eu ; telephone number: (572 286 312).
  3. The Manufacturer grants the Purchaser a quality guarantee for TABELL brand furniture purchased from the Manufacturer (hereinafter:"Goods") in connection with the sales agreement concluded between the Purchaser and the Manufacturer (hereinafter:"Agreement"). This warranty card specifies the scope of services that the Furniture Manufacturer is obliged to provide under the warranty granted to the Buyer upon conclusion of the Agreement.
  4. Whenever this warranty card refers to the Purchaser, it should be understood as the Consumer or Entrepreneur who has concluded the Agreement with the Manufacturer.
  5. Whenever this warranty card refers to the Supplier, it should be understood as the manufacturer or an external entity contractually obligated to deliver and transfer the goods.
  6. Whenever this warranty card refers to the Consumer, it should be understood as the Purchaser who is a natural person performing a legal transaction not directly related to their business or professional activity, as well as a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
  7. Whenever this warranty card refers to the Entrepreneur, it should be understood as the Purchaser who is a natural person, a legal person, or an organizational unit that is not a legal person, to which a separate act grants legal capacity, conducting business activity on its own behalf.
  8. Whenever this warranty card refers to a defect, it should be understood as a physical defect referred to in Articles 556 and 556(1) of the Civil Code, consisting in particular in a reduction in the functionality of the item, its utility, technical or qualitative value, as well as the non-compliance of the item with the provisions of the contract or the rules of good practice. 556(1) of the Civil Code, consisting in particular in a reduction in the functionality of the item, its utility, technical or quality value, as well as the non-compliance of the item with the provisions of the contract or the principles of technical knowledge, with the exception of those specified in particular in §3 of this warranty card.
  9. The warranty covers Goods purchased, delivered, and used in Poland.
  10. The guarantor is responsible for defects arising from causes inherent in the Goods and for damage that is an inevitable consequence thereof.
  11. 11. The Manufacturer declares and assures the Buyer that the Goods have been manufactured correctly, in accordance with the Agreement, to the best of the Manufacturer's knowledge and in accordance with the current rules of technical knowledge and applicable laws and standards.

§2 WARRANTY PERIOD

  1. The warranty period for defects is 24 months from the date of receipt of the Goods by the Buyer who is a Consumer (hereinafter: "Warranty period)
    1. In the case of purchasing clearance or display items, the warranty period is 12 months.
  1. The warranty period is 12 months from the date of receipt of the Goods by the Buyer who is an Entrepreneur (hereinafter: "Warranty Period").

§3 SCOPE OF THE WARRANTY

  1. The warranty does not cover:
    1. Damage caused by improper or careless handling or transportation of the Goods;
    2. Damage, scratches, cracks resulting from improper or careless self-assembly of the Goods by the Buyer (or third parties acting on their behalf), their components or accessories, or the setting of the Goods, in the event that the Goods are delivered to the Buyer in parts, in an unassembled state, and at the express request of the Buyer, are not assembled by an authorized supplier of the Seller;
    3. Damage caused by random events, force majeure,
    4. Damage resulting from repairs or modifications carried out by the Buyer or third parties on behalf of the Buyer.
    5. Damage resulting from improper or non-compliant use, storage, or cleaning of the Goods, contrary to their intended purpose, rules, or instructions.
    6. Dirt and stains on the surface of the Goods arising after receipt of the goods, which has been duly certified.
    7. Changes occurring in the Goods as a result of natural aging processes (e.g., changes in the color and luster of wood, as well as discoloration caused by sunlight, color differences in products ordered at a different time than the original – materials and fabrics from different production batches may have different shades).
    8. Differences in the shade of elements made of natural wood used in the production of Goods, which depend on the habitat conditions of the trees;
    9. Visible wood rays as one of the elements of its natural structure.
    10. Micro cracks formed lengthwise and crosswise, the occurrence of which is a natural phenomenon dependent on temperature and humidity.
    11. Differences in color and shade of wood purchased at different times for the same type/species of wood.      
    12. Differences in the color of wood and natural veneers that may occur in relation to the samples presented to the Buyer at the time of conclusion of the Agreement, resulting from the natural diversity of wood grain and structure and the varying absorption of dye by the wood.
    13. Damage and defects caused by animals.
    14. Defects and damage that were the basis for reducing the price of the product.
    15. Damage visible upon receipt of the Goods not reported during delivery in accordance with the procedure specified in section 5 below.
    16. Filled and repaired knots and cracks in the wood.
  2. Depending on the level of humidity in the air, wood releases or absorbs moisture from the air. The resulting change in the volume of wood is a natural feature that cannot be avoided – wood swells or shrinks, so this does not constitute a defect in the Goods. Depending on climatic conditions, the dimensions of individual elements may differ slightly from their original dimensions. Differences in dimensions from the original dimensions may vary by +/- 1%.
  3. The buyer loses their warranty rights in the event of failure to comply with the rules for use and cleaning of the Goods described in §7 of this warranty card.
  4. The Manufacturer's liability is limited to an amount equal to the price of the Goods subject to complaint. The warranty does not entitle the Purchaser to claim compensation for lost profits related to the defectiveness of the goods.
  5. The Buyer is obliged to inspect the Goods immediately, no later than on the day of receipt of the Goods, in order to verify the conformity of the Goods with the Sales Agreement (i.e., the completeness of the order, quality of the delivered Goods and any damage, and suitability for the agreed use) and to report any reservations regarding the quantity and quality of the Goods to the Seller or Supplier. If the Goods are sent to the place of delivery via a carrier, the Buyer is obliged to immediately (i.e. at the time of receipt of the Goods and in the presence of the carrier's representative or driver) inspect the condition of the shipment and take the necessary steps to determine the carrier's liability for damage caused during transport (damage or loss of the shipment). The Buyer is obliged, together with the carrier's representative or driver, in particular to formally determine the condition of the shipment, specify the damaged or missing quantity and the circumstances of the damage or loss, report any reservations to the report with justification, indicate any difficulties in determining the shipment data, and immediately (i.e. on the same day) notify the Seller of the above and send the Goods receipt report. The Buyer loses their warranty rights if they fail to comply with the procedure described in this paragraph. Acceptance of the shipment without reservations or failure to indicate defects in the receipt report or failure to report damage, loss, or delay in delivery within the above-mentioned time limit shall result in the expiry of the Buyer's warranty claims against the Manufacturer. Confirmation of receipt of the goods shall be deemed to constitute delivery free of defects.
  6. When using underfloor heating, it is necessary to ensure adequate thermal insulation between the heating system and the structural elements of the Product, in particular its legs. The Product should not be placed less than 1 m away from active heat sources (radiators, stoves, fireplaces) and windows. Failure to comply with the above recommendations will result in the loss of the Buyer's warranty rights.
  7. In the case of Goods that are upholstered furniture, the Manufacturer indicates that:
    1. Natural marks, unevenness in structure, and shiny spots within a single set are not considered defects in leather upholstery.
    2. The differences in hardness between individual elements in upholstered furniture are determined by design solutions, as well as the size of individual elements and the type of upholstery fabric used.
    3. Due to the varying properties of the materials used to manufacture the Goods, there may be a difference in the actual dimensions of the upholstered elements (from 0 to 4 cm) in relation to the dimensions specified in the manufacturer's information and on display.
    4. Some fabrics, especially velvet, shimmer in the light, and depending on the angle of incidence, this can create the illusion of differences in fabric shade (this is not a defect, but a characteristic of the product).
    5. Deformations resulting from furniture use, such as foam shifting inside the furniture, are normal. They can be corrected by manually rearranging the foam to restore its original shape.
    6. Damage caused by sitting on the backrest, headrest, or armrest is not covered by the warranty; such damage is considered to be the result of improper use.
    7. As a result of transport or packaging methods, irregular shapes/creases may appear on the furniture after unpacking, but these should return to their original shape within a few days after unpacking. This process can be accelerated by manually arranging/tapping the furniture.
    8. Furniture should be protected from direct exposure to sunlight, as this may result in partial fading of fabrics and upholstery materials.
    9. Furniture should not be placed less than 1 m away from active heat sources (radiators, stoves, fireplaces) and windows. Mobile heat sources should also not be placed near furniture.
    10. Wrinkles and folds in both covers and backrest/accessory cushions are a result of normal use and are not product defects. The larger the surface area of the seats and backrests, the greater the tendency for wrinkles and folds to form. It is advisable to smooth out the surface of the seats and backrest/accessory cushions after prolonged use.
    11. Creases and folds resulting from use with excessive surface load.
    12. The occurrence of pilling, or fuzzing, in woven fabrics is a natural phenomenon that occurs when loose fibers begin to loosen from the surface of the fabric, and over time, abrasion by external factors causes these fibers to form small spherical bundles anchored in the fabric.

§4 OBLIGATIONS AND RIGHTS OF THE PARTIES

  1. If the following is found during the warranty period:
    1. defects which, in the Guarantor's opinion, can be removed, the Buyer has the right to demand from the Guarantor:
      • remove defects at the Guarantor's expense and risk by means of a free warranty repair, or
      • reduce the price of the defective Goods, or
      • replacement of defective Goods with Goods free from defects (in the case of application of warranty provisions)
    2. defects which, in the Guarantor's opinion, cannot be removed or are not economically justified, and which prevent or significantly impede the use of the Goods for their intended purpose (significant defects), the Purchaser shall have the right to demand from the Guarantor:
      • replacement of defective Goods with Goods free from defects, or
      • refund of the sale price of the defective Goods.
    3. The guarantor has the right to inspect the goods or obtain additional information about the circumstances of the defect and the manner of use of the product before proceeding to remove the defects, and an unjustified refusal to inspect and provide information may constitute grounds for refusing to consider the complaint.
  2. Whenever the following provisions refer to "removal of a defect," this shall also be understood to mean the replacement of items included in the Goods with items free from defects.
  3. If replacement of the defective Goods with non-defective Goods is impossible for objective reasons (e.g., discontinuation of production, difficulty in obtaining furniture components from abroad in the foreseeable future), the Guarantor shall fulfill its obligation by refunding the sale price of the defective Goods.  
  4. The Manufacturer decides how to handle Complaints. The Guarantor may accept the Buyer's request to replace the defective Goods with furniture of a different design.

§5 COMPLAINTS

  1. The Buyer shall report any complaints regarding defects covered by the warranty to the Manufacturer immediately after their discovery, but no later than within 7 days of discovering the defect.
  2. When submitting a complaint, it is advisable for the Buyer to indicate whether they are pursuing warranty claims or claims for non-compliance of the Goods with the Agreement, describe the defect noticed, and specify their request.
  3. Complaints should be submitted electronically using the contact form available on the Manufacturer's website, or in writing to the Manufacturer's address, or by sending an email to the Seller's email address: reklamacje@tabell.eu or kontakt@tabell.eu.
  4. A correctly submitted complaint (hereinafter: "Complaint form" or Complaint”) should contain at least:
    1. title (warranty claim),
    2. first name, last name, mailing address, e-mail address of the Buyer,
    3. the date of conclusion of the Agreement constituting the basis for the complaint,
    4. order number,
    5. description of the Goods (name and type of Goods, wood color),
    6. proof of purchase of the Goods (e.g., account statement, card payment confirmation, receipt, or invoice); failure to provide the above constitutes grounds for rejecting claims in their entirety and not proceeding with their consideration.
    7. warranty card,
    8. the reason for the complaint (detailed description of the defect) with an indication of the Buyer's request,
    9. the date and description of the circumstances in which the defect was noticed,
    10. description of the circumstances of use of the Goods,
    11. photographic documentation of defects.
  5. If the data or information provided in the Complaint needs to be supplemented, the Manufacturer may immediately request the Purchaser to supplement it to the indicated extent. Along with such a notification, the Purchaser will be sent information on how to supplement the deficiencies in the complaint form.
  6. The Manufacturer may leave the Complaint unresolved if the data provided by the Buyer is insufficient to consider the Complaint, including determining the Agreement to which the complaint relates or data enabling contact with the Buyer, despite a request to supplement it.
  7. The manufacturer has 14 calendar days to consider a complaint/claim that has been correctly formulated and submitted in accordance with the provisions of §5, section 3, items a-k.

§6 COMPLAINT HANDLING PROCEDURE

  1. The nature of the defect and the manner of handling the Complaint shall be assessed by the Manufacturer. Defects shall be removed by repair or replacement (in particular, replacement of defective materials used), depending on the Manufacturer's decision, justified by the nature of the defect.
  2. The manufacturer will respond to the validity of the complaint within 14 calendar days of receiving a correctly submitted complaint by email or traditional mail.
  3. If prior inspection of the Goods is necessary for the proper consideration of the Complaint, the inspection may be carried out on a date agreed with the Buyer at the location where the Goods are located. The Manufacturer reserves the right to collect the Goods from the Buyer in order to assess the validity of the claim and to inspect the Goods outside the place of use. The Buyer is obliged to prepare the Goods for collection at a time agreed with the Manufacturer. The Manufacturer reserves the right to collect the Goods subject to complaint within 14 working days from the date of receipt of the complaint, unless otherwise agreed. The deadline for considering the complaint shall be extended and shall be counted from the date of the inspection.
  4. The Manufacturer is obliged to proceed with the removal of the disclosed defect within 30 working days from the date of acceptance of the Complaint, unless the Manufacturer and the Purchaser agree on a different date for the removal of the defect.
  5. The deadline for removing defects is 45 days from the date of acceptance of the Complaint by the Manufacturer, unless the Manufacturer and the Purchaser agree on a different deadline for removing the defect.
  6. If the Complaint is accepted and results in a refund, the Manufacturer will refund the price within the above-mentioned period using the same method of payment as used by the Buyer, unless the Buyer has agreed to a different method of refund.
  7. If the nature of the defects does not require their removal in factory conditions, warranty repairs shall be carried out at the Buyer's premises.
  8. If it is not possible to commence or complete the removal of defects for technical reasons within the time limits specified in sections 4 and 5 above, the Manufacturer shall notify the Purchaser thereof, indicating the earliest possible date for their removal.
  9. The removal of defects will be confirmed in a protocol.
  10. The warranty period shall be extended by the time taken to settle the complaint, during which the Buyer was unable to use the Goods covered by the warranty for their intended purpose due to a defect.
  11. There shall be no delay in handling the complaint if the replacement or repair has not been carried out for reasons attributable to the Buyer, including the inability to inspect the Goods. In such a situation, the Guarantor shall handle the Complaints within a new time limit agreed with the Buyer.
  12. In the event of an unjustified complaint or request to the Guarantor to perform a warranty repair, all costs incurred in this respect, including transport and diagnostic costs, shall be borne by the Purchaser.

§7 RULES FOR USE AND CLEANING

  1. The buyer is obliged to comply with the rules for use, cleaning, and care of the Goods specified in Appendix 1 to this warranty card, which forms an integral part thereof.
  1. The buyer loses their warranty rights if they fail to comply with the rules for using the Goods described in the warranty card.

§8 FINAL PROVISIONS

  1. The warranty granted for the sold Goods is an additional right and does not exclude, limit, or suspend the Consumer's rights under the seller's liability for non-compliance of the Goods with the Contract, referred to in the Act of May 30, 2014, on consumer rights.
  2. In matters not covered by this warranty card, the relevant provisions of Polish law shall apply.
  3. If ownership of the subject of the agreement is transferred to a third party during the warranty period, the rights under the Quality Guarantee shall pass to the Purchaser.
  4. The attachments to this warranty card form an integral part of it.

Appendix No. 1

  1. Furniture should be used in accordance with its design and intended purpose, which means that you should not, for example, stand on chair seats and table tops, sit on armrests, headrests, and table tops, or hang/dry clothes and other items on chair backs.
  2. Furniture should be placed on a level surface (to maintain stability when sitting, keep the legs of the product in contact with the ground, do not lean or rock on the chair—unless this function is part of the design).
  3. Furniture should be used indoors and protected from harmful weather conditions. The recommended indoor climate conditions are: temperature 15-25ºC, relative humidity 40-70%. Furniture should not be placed less than 1 m away from active heat sources (radiators, stoves, fireplaces), and mobile heat sources should not be placed within the same distance from the furniture. Furniture should not be placed on wet surfaces: floors/carpets. Furniture should not be exposed to the direct influence of air conditioning or dehumidifying devices, which remove moisture and can dry out the furniture excessively. Failure to comply with temperature and humidity recommendations may result in deformation of the furniture, changes in the shape of curved elements, cracking of wooden parts, damage to upholstery or wickerwork, discoloration, and degradation of the furniture's lacquered surfaces.
  4. Furniture should be protected from direct sunlight. UV radiation can cause color differences in furniture components and degrade paint coatings. The degree of damage depends on the intensity of the radiation, and the color difference between the exposed and sheltered parts may be noticeable during use, e.g., TV tables, extendable tables with retractable inserts.
  5. The usable surfaces of solid wood furniture or furniture covered with natural veneer should be protected from direct exposure to heat, moisture, and chemicals, e.g., hot dishes, irons, liquids, alcohol, solvents, lubricants, and fats, as they may cause damage in the form of discoloration and tarnishing. On the other hand, surfaces of furniture covered with artificial veneer, e.g., HPL laminates, are resistant to heat, moisture, and certain chemicals. However, at the junction of different materials, e.g., narrow veneered surfaces, they should be protected from liquids, alcohol, and substances that can damage surfaces and joints, e.g., gaps, delamination, and blisters may form.
  6. Liquids can have a negative impact on the surface, as they can seep in and cause stains or leave circular marks, e.g., from glasses. Spilled liquids should be wiped dry immediately. Do not allow liquids to get into hard-to-reach places, e.g., under glass or in joints.
  7. Glass surfaces/elements in furniture should be used with particular care. They must not be overloaded, and glass elements must be removed when moving the furniture. In the case of glass tops, make sure that the glass is tempered and check what factors it is resistant to.
  8. To protect the usable surfaces of furniture, coasters can be used, but care should be taken to ensure that the material from which the coasters are made does not leave stains or cause other damage to the surface.
  9. Sharp/rough objects (e.g., hard seams, rivets on clothing) or heavy objects, as well as pets' claws, can damage wood, fabric, and wicker.
  10. Coloring materials, e.g., jeans, can dye light-colored upholstery fabrics as well as natural and artificial leathers.
  11. Some products contain wooden elements with a square/rectangular cross-section and metal elements (e.g., guides, screws, clips) in their construction, so special care should be taken when children are in contact with the furniture.
  12. When using lighting in furniture, do not touch the bulbs directly with your hands. If a lighting element needs to be replaced, use an element identical to the one used by the manufacturer.
  13. Furniture must be leveled and, if necessary, its components adjusted, e.g., hinged doors, drawers, table bases. In the case of floors susceptible to scratches, it is advisable to use protective pads under the furniture. Adjusting hinges and leveling and aligning the furniture is the responsibility of the purchaser.
  14. Furniture requiring assembly must be assembled in accordance with the assembly instructions, using the appropriate tools. During assembly, take special care not to damage the components.
  15. Check the furniture joints periodically. Looseness in the joints resulting from use should be eliminated by tightening the appropriate screws and fasteners.
  16. Movable parts of furniture, such as doors, drawers, and pull-out shelves, should not be left open/pulled out unnecessarily, as this may cause damage and pose a safety hazard. Do not overload furniture elements such as shelves, or lean your entire body weight on the edge of the furniture, as this may cause damage or loss of stability.
  17. Furniture should be moved without any additional load (e.g., empty the contents) and after dismantling or securing the moving parts. When moving, hold onto the fixed vertical elements of the furniture, e.g., sides, legs. Do not hold onto movable elements (doors, drawers), horizontal parts (shelves, tops), and functional elements (handles). Moving furniture across the floor may cause permanent damage to the furniture and the floor. Please note that due to the weight and size of the furniture, it is often necessary for more than one person to work together to transport or move it.  
  18. Upholstered furniture may develop creases and folds as a result of transport, unpacking, and use. These can be reduced by shaking, patting, and manually smoothing out the material to restore its shape.
  19. Like any product of this type, furniture is subject to natural wear and tear during use. In particular, the following may occur: color fading, stretching and creasing of the fabric/leather, indentation of the foam in the seat, fabric wear, fabric pilling, leather shine, and varnish matting or glossing.
  20. In the case of natural leather, surface irregularities, scars, abrasions, and slight differences in shade are typical characteristics of natural materials, while upholstery fabrics may show color differences depending on the type of fabric and the angle of light.

Cleaning instructions:

  1. Furniture should be cleaned regularly to prevent dust/dirt from accumulating and remaining on the furniture for long periods of time.
  2. Surfaces of furniture made of solid wood or covered with natural and artificial veneer, as well as glass surfaces, should be cleaned with a dry, soft, and clean cloth. Wipe off dirt with a damp cloth and then dry immediately by wiping with a soft, dry cloth. In the case of visible dirt (grease) on the surface of the furniture, you can use a solution prepared from a few drops of ordinary dishwashing liquid dissolved in one liter of water, and then immediately dry the surfaces by wiping them with a dry, soft cloth. It is not recommended to soak the furniture with large amounts of water. High-gloss furniture should be cleaned with a dry microfiber cloth. Cleaning should be done along the wood grain. When cleaning, do not apply excessive pressure to the surface to avoid irreversible polishing. The cloth, rag, or other non-woven fabric used for cleaning should be free of sharp, dangerous elements.
  3. Do not use cleaning agents containing abrasive substances, hard sponges, solvents, or chemicals. We advise against using chemical furniture maintenance products, as they may have a negative effect on the appearance of the varnish coating.
  4. Oiled furniture should be cared for in accordance with the oiled furniture maintenance instructions included with the furniture.
  5. Upholstered furniture should be vacuumed with a vacuum cleaner with an upholstery attachment. Furniture upholstered with scan should be vacuumed with a soft, dry, clean cloth, while any stains can be washed with a cloth slightly dampened with water and mild detergent, and then immediately wiped dry. When cleaning, do not apply too much pressure to avoid local color lightening. Furniture upholstered with natural leather should be cleaned by regularly removing dust. Complete cleaning and maintenance of the leather is recommended using special leather care products. Test the product first on a less visible area. Upholstered elements should not be dried in the sun, using dryers or other sources of heat.
  6. Wicker furniture should be vacuumed with a vacuum cleaner set to gentle suction, using an upholstery attachment.
  7. Minor stains can be removed by wiping with a damp cloth. Wicker furniture should be protected from staining liquids, as they may cause permanent discoloration.
